Workers’ Compensation

Updated in 2025 by the ALFA International Workers’ Compensation Practice Group members, this Compendium is designed to serve as a single resource regarding important workers’ compensation legal issues.

Specific issues addressed are:

  • Available defenses to a workers’ compensation action
  • Occupational Disease  (including respiratory and repetitive use)
  • Tort immunity for employers
  • Injuries involving drugs and/or alcohol
  • Procedural directives for litigation of a workers’ compensation claim
  • Insurance requirements and availability

Two new questions were added to the updated Compendium:

  • Question 6: What psychiatric claims or treatment are compensable and is PTSD a compensable diagnosis?
  • Question 29: Are there any specific compensability requirements or applicable statutes for hybrid employees?
