Telephone Consumer Protection Act (TCPA) -
Utah
Does your state have its own version of the TCPA?
No. Utah does not have its own version of the Federal Telephone Consumer Protection Act as of January 2025.
Does your state have state specific consumer protection statutes that are often paired with TCPA or its state iterations?
While there is no TCPA in Utah, the State has both the Utah Telephone and Facsimile Solicitation Act, Utah Code §§ 13-25a-101, et seq., and the Telephone Fraud Prevention Act, Utah Code §§ 13-26-1, et seq. (collectively, “Utah Statutes”). Utah Courts have held that the Utah Statutes are not preempted by the federal TCPA, and may be asserted in addition to such claims. See Utah Div. of Consumer Prot. v. Flagship Cap., 2005 UT 76, ¶ 2, 125 P.3d 894.
