Legal malpractice continues to be a primary concern for law firms and their insurance carriers. Malpractice claims have recently increased and will likely continue to increase as Plaintiffs develop ongoing theories for these claims. The difficult-to-settle case, bad faith set-up, settlement remorse, management of complex litigation, cybersecurity, social media, social networking, and e-discovery - all have heightened the complexity of today’s law practice. They discussed the emerging trends and hot topics in malpractice litigation while gaining the tools for mitigating claims and creating the defensible claim.
