Impact of the coronavirus pandemic on traditional business models have been unprecedented and disruptive. Businesses globally have been forced to introduce fundamental changes to workforce utilization, supply chains, distribution channels, customer experience and other operational issues. As corporations deal with short-term liquidity issues and profitability, investments in new processes, technologies and resources are already being planned to adapt to the challenges of an uncertain market. Economies across the world are responding with unique measures to transition to the next normal in the post-COVID future. With this backdrop, the ALFAI panel of lawyers will share their experience of business challenges and strategies in their respective jurisdictions.

Panelists:

BRETT M. COWELL is a founding partner and the chairman of the ALFA International member firm, Cowell Clarke, in Sydney and Adelaide, Australia. He is also head of the Corporate Practice Group. Brett advises the firm’s corporate and business clients on corporate transactions, takeovers, mergers and acquisitions, securities market issues, capital raisings, debt and equity funding and joint ventures. In connection with these matters, he deals with banks and corporate advisors, private equity and venture capital investors, underwriters, ASX and ASIC. He consults to board chairs and CEOs on corporate issues such as strategic issues, governance and shareholder relations, including activist matters. Clients range from large publicly listed companies to smaller, fast growing entrepreneurial businesses. Many of the transactions Brett advises on involve high value IP and technology assets. He is also a nonexecutive director on a number of boards.

RAJARSHI CHAKRABARTI (Raj) is a senior partner with ALFA International member firm, Kochhar & Co., in Mumbai, India. His practice focuses on corporate commercial transactions with emphasis on regulatory environment and risk mitigation. Raj has substantial experience in cross-border mergers & acquisitions, joint ventures, technical collaborations, business and assets restructuring. He regularly advises global corporations on range of issues concerning their Indian operations. As part of his practice, Raj also oversees complex litigations and negotiations relating to shareholder disputes, large commercial claims and proceedings instituted by regulatory agencies. He has significant expertise in liaison and advocacy with regulatory and law enforcement authorities. His work includes assisting clients in diverse sectors such as banking & financial services, private equity and venture capital investment, telecom, engineering, retail, biotechnology, e-commerce, IT and ITES.

CHRISTIN KRAMER is a core member of ALFA International member firm, Tiefenbacher, in Heidelberg, Germany. She is a part of the International Division and leading partner of its corporate and commercial practice. Christin advises both German and international clients in all fields of corporate and commercial law with a particular focus on cross-border transactions. In January 2019, she obtained the distinction of being a Certified Specialist in Commercial and Corporate Law. She is therefore well experienced not only in transactional law but in all ramifications of corporate law, such as disputes between shareholders, litigation, directors‘ and officers‘ liability. Christin joined Tiefenbacher in September 2015, right after being admitted to the bar, and was named first female partner of their main office Heidelberg in January 2019.

MARY R. ROBBERSON is a partner with ALFA International member firm, Higgs Fletcher & Mack, LLP, in San Diego, California. She practices in the area of business litigation, with a focus on cross-border litigation involving Spanish speaking countries. The international aspect of Mary’s practice includes representing both US and foreign entities and individuals in commercial litigation which often includes simultaneous litigation in foreign jurisdictions. The gamut of Mary’s experience includes successfully litigating disputes for her clients beginning with jurisdictional and forum-related issues, through trial and judgment enforcement proceedings involving multiple domestic and foreign defendants, as well as substantial experience in the areas of alter ego and successor liability as they relate to judgment enforcement. Mary presents at various informational seminars to assist the Latino community, including, in the past, co-hosting a radio show on the Univision radio station, Recuerdo on 102.9 FM. She is the co-chair of ALFA International’s International Law Practice Group (ILPG) and is a former member of the Board of Directors.

ANJULI SIVARAMAKRISHNAN is the managing partner of the ALFA International member firm, Kochhar & Co., in Dubai, UAE. Her practice areas include banking, finance, private equity, mergers, acquisitions, foreign investments, securities laws, structured finance, cross-border financing, project finance, regulatory approvals, corporate restructuring, individual’s succession and inheritance planning. Anjuli regularly advises banks on advancing credit facilities, creation and enforcement of security interest. She has substantial experience advising clients from diverse sectors including but not limited to automotive, aviation, energy, ecommerce, financial services, technology, infrastructure, oil and gas, real estate and retail. She has hands on experience in setting up of offshore and domestic fund vehicles, foreign company subsidiaries and joint ventures in the UAE, investment structuring and restructuring of entities.

JOHN SYKES is a partner with ALFA International member firm, Charles Russell Speechlys, in London. He specializes in corporate and commercial litigation, arbitration and mediation, with much of his work being international in nature. John is a specialist in corporate dispute resolute currently working with companies and individuals in shareholder and joint venture disputes, director duties, share purchase agreement claims, partnership and claims of corporate fraud. International work this year has included work in the US, Sierra Leone, Zambia, France, Norway and the Middle East. Additionally, John acts for global technology firms in complex technology development disputes and he is currently working on a cross-border trade agreement between France, the US and England, claims regarding installation of smart meter technology in homes and between leading mobile telephony operators. His work in international trade includes arbitrations involving trading agreements concerning oil and gas, mining, shipping and technology. John works for early and successful resolution of client’s disputes using the most cost-effective tools of litigation and mediation.
