About the Webinar:

This workshop envisions the hours after a company learns that its computer system has been hacked and that the personal information of employees and customers has been stolen. A discussion of case studies will highlight the types and causes of cyber-risks that businesses face, the practical and potential legal implications of a breach, appropriate procedures for responding to a data breach, and proactive safeguards that can limit liability for such events.  Additionally, the workshop will highlight the special risks facing law firms in safeguarding confidential client information.

Panelists:

Devin Chwastyk leads the Privacy & Data Security Group at McNees Wallace & Nurick and has practiced in the firm’s Harrisburg, Pennsylvania office since 2003.  Devin advises businesses on privacy policies and practices.  He assists the firm’s clients in taking proactive measures, including the creation of data security policies and breach response plans, to reduce their risk of data exposure and limit liability should it occur.  He has counseled dozens of entities victimized by data breaches in meeting their obligations under state, federal, and international laws.  Devin holds the Certified Information Privacy Professional designation from the International Association of Privacy Professionals, and regularly speaks and writes on privacy and data security issues.  His practice otherwise is focused on complex commercial litigation in federal and state courts throughout Pennsylvania and around the country.  Devin has represented financial institutions in litigation against merchants for failure protect consumer information, and obtained one of the first federal appellate court rulings recognizing a right to recover in such cases.

Chuck Kunz is a partner in the Wilmington, Delaware office of Morris James LLP where he chairs the firm’s Data Privacy and Information Governance Group and also represents creditors in business bankruptcy cases and related litigation. As chair of Morris James’s Data Privacy group, Chuck advises business clients on data management techniques, negotiates vendor contracts, counsels clients on appropriate protection and disposal of protected and confidential documents and electronic records, and consults with clients regarding breach notification obligations.  Along with other members of the group, Chuck counsels directors and officers of Delaware corporations on appropriate exercise of fiduciary duties in the realm of data privacy and information governance. Chuck has published articles relating to privacy laws and related issues, and frequently speaks to legal and business trade groups on issues relating to data privacy and security.  Chuck is a Certified Information Privacy Professional/US, a member of the International Association of Privacy Professionals, and is admitted to practice in Delaware and various federal courts around the country.
