About the Webinar:

Receiving a bankruptcy notice for a prior vendor, customer, or business associate is a common, but an often confusing experience for companies of all sizes.  During the webinar, the panelists will provide an overview of the bankruptcy process and some helpful tips on what to do after receiving a bankruptcy notice. The panel will discuss what actions a creditor should take to preserve its claim and maximize recovery. Additionally, the panel will delve into an all too common problem for creditors – preference litigation, which often arises when a single creditor accepts an inordinate payment from a debtor shortly before the debtor files for bankruptcy. The group will discuss how to avoid preference litigation as well as the various defenses a creditor may have in these proceedings.

Panelists:

AMELIA ADAMS joined ALFA International member firm Stoll Keenon Ogden PLLC’s Lexington, Kentucky, office as Counsel to the Firm following a career including law practice, nonprofit administration, and banking administration.  Amelia offers skilled guidance to all types of constituencies in insolvency situations, both in litigation and out-of-court workout negotiations. She has represented business and individual debtors, as well as creditors, in chapter 7, 11, 12, and 13 bankruptcy cases. She has also represented parties in adversary proceedings regarding preferential and fraudulent transfer claims, lien avoidance, nondischargeability disputes, and other issues. Thoughtful in her approach to service, Amelia develops strategies to help clients feel confident about working through difficult financial and legal situations. Combined with her training as a mediator, these experiences make her a strong asset in debtor-creditor relations matters.

DAN PETERSON is a partner at ALFA International member firm, Cosgrave Vergeer Kester LLP, in Portland, Oregon. Dan focuses his practice on all aspects of commercial, real estate, and business litigation. He has a specific emphasis on protecting creditors’ rights and pursuing its remedies, both inside and outside of bankruptcy. In that capacity, he has litigated relief from stay matters, preference disputes, objections to bankruptcy plans, and various other adversary proceedings. In addition, Dan regularly counsels clients on strategies in dealing with “troubled” accounts before bankruptcy.

WALKER TERRY is a director at ALFA International member firm, McCandlish Holton, PC, in Richmond, Virginia. Walker focuses his practice on creditors’ rights matters as well as civil litigation. In his creditors’ rights practice, Walker represents lenders and other business entities in collection actions and bankruptcy proceedings. He has represented creditors in Chapters 7, 11, and 13 cases and routinely counsels clients on applicable bankruptcy law and procedure.
