Hawkins Parnell & Young, LLP (Atlanta, GA) Secures Summary Judgment in the Southern District of Georgia for Healthcare Provider

Hawkins Parnell & Young partners Matthew Barr and Carl Anderson, Jr. obtained summary judgment in favor of the corporate healthcare provider TransformHealthRx (THRX) in the U.S. District Court for the Southern District of Georgia. This victory for Hawkins Parnell’s client follows ten years of litigation.

The original lawsuit was a civil rights and tort action against the Effingham County Jail, Sheriff’s Department, Board of Commissioners, and THRX. The plaintiff’s executrix filed a renewal action with multiple federal and state claims related to the decedent’s incarceration and medical treatment.

Matt and Carl countered the plaintiff’s claims of improper medical treatment by THRX, arguing that the Federal Rules of Evidence, Georgia rules for experts in medical malpractice cases, and Daubert should be applied to find the plaintiff’s expert testimony unreliable and inadmissible. Chief Judge J. Randal Hall granted THRX’s motion to exclude the plaintiff’s expert, Dr. Potts, and granted the motion for summary judgment, ultimately leading to a 51-page order supporting THRX’s position.
