Our panelists discuss handling a trucking claim in the following three parts.

Key Post-Accident Technology: With each passing day technological advancements provide additional avenues for potential post-accident evidence.  The first 24-48 hours may be the only time you have to procure the electronic evidence available to you, and it is imperative to identify, obtain, and secure all potential electronic evidence immediately to best understand the case and avoid spoliation arguments in the future.

New Focus from Plaintiff’s Attorneys on Brokerage Agreements: Plaintiffs’ attorneys, dissatisfied with current mandated insurance limits, have sought additional targets under creative theories of liability. In recent years aggressive plaintiffs have explored new theories upon which to fix liability on transportation brokers for casualty losses.

Updated Trial Tactics of Plaintiff’s Attorneys: Plaintiffs are constantly looking for ways to bolster their case at trial, both by what they say and do, and don’t do.  Plaintiff’s attorneys are now working the reptile theory into their case during voir dire, plaintiffs themselves are steering clear of trial, and plaintiffs are leaving out their past medical damages.

Panelists:

AUDRA DICKENS is an Associate in the litigation practice group at the ALFA International Richmond, Virginia firm McCandlish Holton. Her practice focuses on civil litigation, primarily in the areas of automobile liability defense and trucking defense, as well as premises and products liability defense. She also has experience in workers’ compensation defense and numerous state and federal appellate matters. Audra has successfully represented clients in state and federal courts across the Commonwealth. Audra is the incoming vice-chair of the Auto & Transportation Liability section of the Virginia Association of Defense Attorneys (VADA).

MICHAEL O’MALLEY is a partner with Franden, Farris, Quillin, Goodnight + Roberts who primarily litigates matters in state and federal court in Oklahoma and Kansas.  His practice emphasizes the defense transportation companies in catastrophic accidents. 95% of his practice is litigation.

SEAN WALSH joined ALFA International Wichita, Kansas firm Hinkle in the fall of 2011. His practice focuses Primarily on Civil Litigation, practicing consistently in State and federal Courts throughout the State of Kansas. Mr. Walsh has also succesfully argued before the Kansas Court of Appeals. His practice includes representing clients in Commercial & Comple Litigation, Employment Litigation, Transportation & Motor Carrier Litigation, Construction Litigation, Oil & Gas, and Product Liability Mr. Walsh consistently defends catastrophic personal injury occurences, medical malpractice actions, and business litigation matters such as business dissolution and valuation disputes OSHA whistle-blower actions, non-competes and employment discrimination.
