About the Webinar:

This webinar will address the failure to warn claim as it has become known in today’s litigation environment. Panelists will talk about the development of law surrounding failure to warn claims and anticipated issues moving forward in light of relatively recent developments, such as claims related to COVID-19 and the potential impact of products being displayed on social media in ways that were clearly beyond those contemplated by manufacturers.

Panlelists:

ROBERT MULLINS is a trial attorney and partner with the ALFA International member firm of Gibson, McAskill & Crosby, LLP, in Buffalo, New York. Robert joined the firm in December 2001. He focuses his practice on toxic tort defense, strict product liability defense, general insurance and trucking industry defense, industrial and construction accident defense, and municipal defense throughout New York State. He is the lead trial counsel for a national automotive manufacturer throughout upstate New York and, on a number of occasions, has been admitted (pro hac) as trial counsel outside of New York in asbestos litigation. Robert has also tried cases throughout New York in the areas of strict product liability and trucking industry defense. He is admitted to practice in the state of New York and all New York federal district courts. He has an AV Preeminent rating through Martindale-Hubbell. Prior to joining his firm, Robert served three years in the US Army JAG Corp. Robert is a graduate of the State University of New York at Geneseo and he received his Juris Doctor from the University of Akron, School of Law, where he was a member of the Akron Law Review.

GRETCHEN SCHULER is the Vice President- Insurance Risk Management for Invacare Corporation in Ohio. Invacare is an industry leader in the manufacture and sale of durable medical devices. Gretchen received her BA from the University of Mount Union and her MA from Cleveland State University. She is accredited by the Insurance Institute of America as an Associate in Claims (AIC) and an Associate in Insurance Services (AIS). Gretchen manages Invacare’s global insurance and corporate social responsibility programs, as well as North American product liability claims and litigation.

SARAH SPENCER is a shareholder of the ALFA International member firm of Christensen & Jensen in Salt Lake City, Utah. Sarah defends complex tort and commercial cases in Utah and Colorado state and federal courts.  She is also an experienced appellate advocate. She regularly represents both appellants and appellees in appeals in Utah and Colorado appellate courts and in the 9th and 10th U.S. Circuit Courts of Appeal. She is a 2004 graduate of the University of Denver Sturm College of Law.
