Businesses throughout the country are struggling to reopen – and stay open – during the COVID-19 pandemic. During this webinar, we will discuss practical and reasonable ways to navigate the new normal, while mitigating risks of litigation. Topics will include the development and communication of safety protocols, ensuring compliance with state and local regulations, workers’ compensation, the role of waivers, and litigation risks, including the use of public nuisance common law.

Panelists:

MATTHEW C. MURPHY is an experienced litigator with ALFA International member firm, Nilan Johnson Lewis PA, in Minnesota. Matthew’s diverse practice ranges from personal injury and product liability defense to business and intellectual property disputes. He represents many ski and other recreation areas against personal injury claims; a Class I railroad in FELA ligation; and manufacturers of consumer and industrial products against design defect, manufacturing defect, and failure to warn claims. Matt also represents companies and individuals in copyright, trademark, and trade secret litigation; handles breach of contract cases, including non-competition and sales representative agreements; and defends companies against allegations of unfair competition and consumer fraud. Matt enjoys working proactively with clients to ensure their marketing and advertising campaigns could not be construed as misleading or deceptive and, in particular, that their environmental marketing claims are FTC Green Guide compliant.

SHANE P. SWILLEY is a partner with ALFA International member firm, Cosgrave Vergeer Kester LLP, in Portland, Oregon. Shane focuses his practice in the area of employment law. He provides clients with advice and counsel on personnel matters, HR investigations, company policies and procedures, employment agreements, and compliance with employment laws. He also litigates claims of discrimination, retaliation, wage-and-hour violations and violations of other employment laws before administrative agencies, in arbitration, and in state and federal court.
