About the Webinar:

When an insured submits a claim to its carrier in a manner that the carrier believes is “late,” what are the rights of the insurer? This Webinar will explore the myriad approaches taken by the various states across the United States as it pertains to the “Notice-Prejudice Rule.” Which states require prejudice and which do not? What constitutes untimely notice? When is the carrier prejudiced by the late notice? Join us for an overview of the Notice-Prejudice Rule and its application across the United States.

Panelists:

CHESTER HILL is a partner with Cosgrave Vergeer Kester LLP, the ALFA international member firm in Oregon.  He is a trial lawyer who focuses his practice on all areas of commercial, financial, and real estate litigation.  In the insurance coverage context, he frequently advises insurance companies on their coverage obligations with respect to their insureds, and their rights vis-à-vis other insurers.  He often litigates those disputes as well.

KRISTIAN MORIARTY is a partner with Haight Brown & Bonesteel, LLP, the ALFA International member firm in Los Angeles, CA. His practice centers on insurance coverage litigation amongst disputing carriers, bad faith litigation, and providing coverage advice to carriers and insureds. He has extensive experience interpreting myriad lines of coverage, including general liability, property, auto, homeowners, builders risk policies and wrap-up insurance programs.
