Across cultures and centuries, coming together to battle against a common external menace is a fundamental theme of human history. Yet equally fundamental is sorting out differences and disputes once that threat has been diminished. Grievances put aside in the moment of threat must still be resolved.

As businesses and, more broadly, as society, it appears that such a post-crisis inflection point for resolution of accumulated grievances may be upon us. Litigation is often the venue for such resolution, particularly when the ideals of how we should govern our affairs fail to squarely meet the actual practices of governing our day-to-day actions. In this year’s Business Litigation Seminar, the presentations and round-table discussions will examine common business litigation problems arising in the aftermath of the most recent common external menace.

Setting the stage for discussions will be the challenges private equity firm “Fort-Stone” faces as a result of its improvidently timed acquisition of the “TK World” suite of businesses and assets (physical and intellectual), its expansion strategies and its agreement to sell certain business lines. Fort-Stone’s circumstances are akin to those with which most businesses will grapple during what promises to be a dynamic post-crisis “peace,” More importantly, the Seminar will strive to provide tools and insights to help you move forward into the peace.
