Litigation is an inevitable part of business. It often forces us to react to an opponent’s timing, choice of forum and venue. Proper planning can change that dynamic, and put you in control of the dispute resolution process. Designed to help you take charge of your litigation risks, this year’s Business Litigation Practice Group Seminar focuses on building an optimal dispute resolution process from the ground up. In four panel discussions, we will take you through the mechanics of preparing for litigation risks before they arise, identifying means to resolve disputes before they get out of control, dealing with litigation when it rears its ugly head, and building a framework for settlement that protects your company now and into the future.

The underlying fact pattern for our discussions revolves around a business acquisition, including the drafting of a purchase and sale agreement. Attendees will learn about the critical choices to be made in the negotiation and drafting stage of the transaction, and how those choices affect resolution of disputes that may arise. We will also explore effective techniques for ending disputes that do emerge, without expending an inordinate amount of resources, as
well as crafting a settlement that alleviates future disagreements.
