L.O. Baptista Advogados (São Paulo, Brazil) Article: ECA Digital: New Duties for Digital Companies

The Digital Statute of the Child and Adolescent (Law No. 15,211/2025) came into force, establishing a new regulatory framework for the protection of children and adolescents in digital environments in Brazil.

The law applies to any information technology product or service directed to children and adolescents or likely to be accessed by them, regardless of the place of development, offer, commercialization or operation. This is a relevant change in the normative incidence criterion, with direct impacts on companies that operate digital platforms, applications, online services, games, marketplaces, and digital ecosystems in general.

Our Privacy & Data Protection team, led by partners Esther Jerussalmy Cunha and Fabricio Polido, has prepared a special booklet with the analysis of the main points of the new Bylaws, highlighting the regulatory duties, the impacts on digital business models and the legal risks associated with the concept of probable access.
