On February 6, 2023, Whitfield & Eddy Law attorney Matthew Jacobson, working with co-counsel Joseph Redd and Peter Urreta of New York, successfully obtained summary judgment on behalf of Whitfield & Eddy Law client, Prokraft Inc., in the United States District Court for the Eastern District of New York.
Prokraft distributes food processing equipment throughout the United States, including meat grinders. In this particular case, the plaintiff suffered a grave amputation injury at his workplace when he reached into an operating Pro-Cut meat grinder after the protective guard had been sawed off by the purchaser of the grinder — who was the plaintiff’s employer. The Court ultimately ruled in favor of Prokraft’s argument that there was no evidence that it was foreseeable that a customer would purposefully cut off a safety guard and that the safety labels on the grinder warned against the very conduct in which the plaintiff engaged. As a result of the Court’s opinion, judgment was entered in favor of Prokraft and the case dismissed.
