Gentry Locke Webinar on February 28, 2023: A World Without Noncompetes: What Is an Employer to Do?

On January 5, 2023, the Federal Trade Commission (“FTC”) created a stir when it released a Proposed Rule that, if implemented, would prohibit the use or enforcement of post-employment noncompete provisions. The Proposed Rule would extend to most workers, whether paid or not and would require employers to rescind existing noncompete agreements within 180 days of the publication. On February 1, 2023, a new federal law was introduced in the Senate with bi-partisan support, which would ban the use of most noncompetes with most employees. What about the Virginia law enacted in 2020?
