This webinar will provide an introduction and overview of the current trends in Fair Debt Collection Act cases and strategies for defending those cases. Our discussion will include the increase of class action cases, the impact of recent Supreme Court decisions on certain defenses, and tips on how to approach and resolve Fair Debt Collection Act cases. This webinar is intended to provide valuable insight to those who are both inexperienced with Fair Debt Collection Practices Act cases and those who regularly defend them.
JEFFREY S. HENGEVELD is a shareholder and member of Plunkett Cooney's Board of Directors who focuses his practice primarily in the area of professional liability and consumer litigation. He serves as Co-Leader of the firm's Professional Liability Practice Group and regularly defends attorneys and accountants in malpractice actions. As a member of the Consumer Litigation Practice Group, he regularly defends debt collectors in cases, including class actions, involving alleged violations of the Fair Debt Collection Practices Act, Fair Credit Reporting Act, and Telephone Consumer Protection Act, as well as various state laws related to consumer protection. He is a published author on the issue of accounting standards and fraud deterrence and on professional liability insurance coverage. He was awarded an AV-rating from Martindale-Hubbell and named a Top Lawyer in Legal Malpractice Law by business Magazine and a “Rising Star” by Michigan Super Lawyers. He received his B.A. from Michigan State University and his J.D. magna cum laude from Michigan State University College of Law, where he was a member of the Law Review.
ROBERT E. SABIDO specializes in consumer financial services litigation and compliance, with an emphasis on representing banks, mortgage lenders and servicers, creditors, debt buyers, debt collectors, and other financial services providers. He is the practice group leader of Cosgrave’s Financial Services Practice Group. Robert has successfully defended and represented financial services providers against individual and class actions asserting violations of various federal and state consumer protection laws – including the Fair Credit Reporting Act, the Fair Debt Collection Practices Act, the Telephone Consumer Protection Act, the Real Estate Settlement Procedures Act, the Oregon Mortgage Lender Law, the Oregon Unlawful Trade Practices Act, and the Washington Consumer Protection Act – in all Oregon and Washington federal and state courts, and in the Ninth Circuit Court of Appeals. Robert also assists financial services providers in responding to regulatory enforcement actions. In addition to his litigation practice, Robert counsels financial services providers on compliance issues; and assists them with developing effective policies and procedures, and compliancemanagement systems. Before going into private practice, Robert serves as an Assistant Attorney General in the Appellate and Trial Divisions of the Oregon Department of Justice.
