How schools treat transgender students as it relates to the use of locker rooms or restrooms has become a hotly debated issue throughout the country. It is anticipated that the issue regarding the treatment of transgender students’ and employees’ use of restrooms and locker rooms will continue throughout the Federal District Courts within the United States. Our panelists will discuss the evolution of transgender issues and the law, several recent Federal decisions, and best practices for employers to attempt to avoid litigation.
Schaun D. Henry is a partner of the Harrisburg, Pennsylvania ALFA International law firm of McNees, Wallace & Nurick LLC., where he provides representation and counseling to employers on a wide range of federal, state, and local labor and employment matters. Mr. Henry provides guidance for employers on unfair labor practices and other labor relations issues, as well as providing representation for employers at labor arbitrations and negotiations. He has lectured extensively on many of these topics and has conducted training sessions for human resources professionals as well. Before undertaking the practice of law, Mr. Henry served in the Armed Forces, concluding his service as a major in the United States Army Special Forces. He is a graduate of West Chester University and the Dickinson School of Law.
Kelly Hoffman is an attorney in the Portland, Maine ALFA International law firm of Norman, Hanson & DeTroy. Ms. Hoffman’s practice includes employment and discrimination matters, insurance defense and subrogation, professional liability defense, business defense and prosecution, OSHA compliance and investigations, and tax concerns. In 2013, 2014 and 2015, she was listed in New England Super Lawyers as a Rising Star, an honor bestowed upon only 2.5 percent of her peers. In 2014, Kelly achieved Martindale Hubbell’s highest peer achievement rating (BV® Distinguished™) for a lawyer who has been admitted to the bar from 5-9 years. At Johns Hopkins University, Kelly had the honor of being an aide to Senator John W. Warner of Virginia. She also was the goal keeper for both the field hockey and lacrosse teams. She is a record-holding athlete who was honored as an All-American in field hockey. She continues her love of field hockey today as the head coach of the Waynflete School’s field hockey team.
